因为水患、火警、地动、干旱、搏斗或和议一方没辙预示、遏制、制止和克复的其余事变引导不许或姑且不许十足或局部实行本和议 ， 该方不负负担 。然而 ， 受不行抗力事变感化的一方须尽量将爆发的事变报告另一方 ， 并在不行抗力事变爆发15天内将相关组织出示的不行抗力事变的表明寄交对方 。
force majeure：
either party shall not be held responsible for failure or delay to perform all or any part of this agreement due to flood, fire, earthquake, draught, war or any other events which could not be predicted, controlled, avoided or overcome by the relative party. however, the party affected by the event of force majeure shall inform the other party of its occurrence in writing as soon as possible and thereafter send a certificate of the event issued by the relevant authorities to the other party within 15 days after its occurrence.
18 评断：
在实行和议进程中 ， 如爆发争议 ， 两边应和睦计划处置 。若经过和睦计划未能完毕和议 ， 则提交华夏国际交易激动委员会对外交易评断委员会 ， 按照该会评断步调暂行规则举行评断 。该委员会确定是结果的 ， 对两边均有牵制力 。评断用度 ， 除另有规则外 ， 由败诉一方承担 。
arbitration
all disputes arising from the execution of this agreement shall be settled through friendly consultations. in case no settlement can be reached, the case in dispute shall then be submitted to the foreign trad arbitration commission of the china council for the promotion of international trade for arbitration in accordance with its provisional rules of procedure. the decesion made by this commission shall be regarded as final and binding upon both parties. arbitration fees shall be borne by the losing party, unless otherwise awarded.
由乙方控制搬走 。由乙方减少的装修(囊括新增恒定的外墙、窗、灯具、门及其余摧毁后会破坏室内情景的情景等)乙方不得废除 ， 免得妨害室内的装修情景 。(或由两边按照其时的本质情景计划处置)
八、包租、让渡和调换 8-1乙方在租借期内 ， 需事前征得甲方的书面承诺 ， 方可将该衡宇局部或十足包租给他人 。8-2 乙方包租该衡宇 ， 应按规则与受租方签订书面包车型的士包租公约 。并按规则由甲方(或甲方委派乙方)进取海_______区房土地资产买卖重心处置备案存案 。8-3 在租借期内 ， 乙方将该衡宇让渡给他人承包租赁或与他人承包租赁的衡宇举行调换 ， 必需事前征得甲方书面承诺 。让渡或调换后 ， 该衡宇承包租赁权的接受 *** 人或调换人应与甲方签署租借主体变换公约并连接实行本公约 。8-4 在租借期内 ， 甲方如需出卖该衡宇 ， 应提早____个月报告乙方 。乙方在一致前提下有优先购置权 。按照国度法令 ， 甲方出卖本衡宇给第三人后 ， 本公约连接灵验 。
